Bankruptcy Filing Fees

What Does It Cost To File Bankruptcy?

Under the new bankruptcy laws it now costs $335 to file for bankruptcy under chapter 7 and $310 to file for bankruptcy under chapter 13. Couples filing only pay one filing fee. The court may allow you to pay this filing fee in installments if you cannot pay all at once.

The number of installments shall not exceed four(4), and the final installment shall be payable not later than 120 days after filing the petition. For cause shown, the court may extend the time of any installment, provided the last installment is paid not later than 180 days after filing the petition. Fed. R. Bankr P. 1006(b)(2).

The 1Clickbankruptcy.com software includes the new bankruptcy form to apply for a hardship waiver, which if approved by the bankruptcy court, waives the court costs for a chapter 7 bankruptcy filing.

The district court or the bankruptcy court may waive the chapter 7 filing fee for an individual debtor who: (a) has income less than 150 percent of the poverty guidelines last published by the United States Department of Health and Human Services (DHHS) applicable to a family of the size involved; and (b) is unable to pay that fee in installments.

The 1Clickbankruptcy software program generates the official forms and instructions for paying the filing fees in installments as well as the chapter 7 waiver.
